It comes as a surprise to many who have experienced a divorce situation, but ex-spouses can obtain Social Security benefits based on the record of a former spouse. This can be critical, especially if the former spouse was the higher earner. But what’s even more surprising to many is that obtaining these benefits does not impact the former spouse’s benefits and can even be done without their knowledge. Your question does not obtain enough information for me to respond to it properly. The general rule is that a felony conviction has no impact on your eligibility for Social Security benefits or SSI benefits. There are some exceptions to this rule. You are not eligible for Social Security Disability (SSDI) if: your disability arose (or was made worse) while committing a felony, or your disability arose (or was made worse) while you were imprisoned in a jail, prison, or correctional facility for a felony conviction.
