An Update on SSA’s Overpayment Clawback Reform measures

Eight months ago, Social Security Commissioner Martin O’Malley announced plans for policy changes intended to address the heavy criticisms facing the Social Security Administration in the face of its efforts to recover funds incorrectly paid to some beneficiaries. In a Cox Media Group post by David Hilzenrath and Jodie Fleischer today on Kaiser HealthNews, some of the progress recorded in this effort is recapped. For example, the prior practice of a 100% withholding of benefits in suspected overpayment situations has been discontinued. Still, progress on revising the statute of limitations on governmental claims has stalled, evidently awaiting legislative action. Likewise, the “burden of proof” issue remains unresolved, as do claims of customer service problems encountered by folks involved in the clawback process.
