Are You Eligible for a Social Security Spousal Benefit? - The Motley Fool
Both current spouses and divorced spouses may be eligible for a spousal benefit. A spouse can receive a spousal benefit if their spouse is eligible for a Social Security benefit and already receiving it. You don’t even have to have ever worked! Being eligible for a spousal benefit does not include you having to be eligible for a Social Security benefit on your own work record.
You can receive a spousal benefit equal to 50% of your spouse’s benefit if you don’t claim any benefits until you reach your full retirement age (FRA). A current spouse must have been married for at least 1 year, and their spouse must be taking their own benefit. A divorced spouse must have been married for at least 10 years, and their ex-spouse does not have to be receiving their benefit, but must be at least 62 years old or receiving Social Security Disability (SSDI).

Hello Debbie. We are so sorry to hear of your issues, but I’m afraid we do not have the ability to alter where your Social Security survivor benefits from your late husband are paid. If you are in a skilled nursing facility, then it is likely that your children have arranged for your Social Security benefits to be paid directly to that nursing facility. And that is something that was previously requested of and approved by the Social Security Administration, based upon a request made (either by you, your children, or the skilled nursing facility). If effect, the nursing facility was appointed as your “Representative Payee” meaning that your monthly SS amount is paid to them for your benefit. The only way to change that is for you (and/or your children) to ask Social Security to alter the payment arrangement.
I suggest that you have a meeting with your family to express your dissatisfaction with your current circumstances. If your family agrees to an alternative, then they can ask the Social Security Administration to change where and to whom your Social Security benefits are sent.
