Social Security Benefits and the Divorced: Some Important Facts

With a recent survey by MassMutual noting that a surprising number of Americans are not clear on the rules surrounding Social Security benefits available to divorced spouses, a post by Aman Jain on valuewalk.com can play an informative role in educating many folks. As Mr. Jain explains, there is a set of basic criteria governing the prerequisites for divorced spouses to obtain benefits:

  • You must be at least 62 years old.
  • You must be unmarried. If you remarry, you may still qualify for the benefit if your recent marriage ends in annulment, divorce or death.
  • Your ex-spouse must be eligible for Social Security benefits.
  • The marriage must have lasted at least 10 years.
  • You must have been divorced for at least two years.
  • Your own Social Security benefit must be less than the divorced spouse’s Social Security benefit.
